This brief survey suggests some of the issues that can be investigated by a careful analysis of the relationship between legal institutions and the economy in the ancient world. By investigating legal institutions, we can better understand the relationships that shaped the economy and the likely implications of these relationships for economic performance. Agriculture in ancient Rome

Slavery in the ancient world, not to mention in the city of Rome itself, was vital to both the economy and even the social fabric of society. Whilst it was commonplace throughout the Mediterranean region, and the Hellenistic regions in the east, it was not nearly so vital to others as it was to the dominance of Rome. As the Romans consolidated their hegemony of Italy and Sicily, followed by the systematic conquest of western Europe, countless millions of slaves were transported to Rome, the Italian countryside and Latin colonies all over Europe. Though slavery was prevalent in households throughout the city itself, it was on the farms and plantations where it had its greatest effect. The Roman conquests of Carthage, Macedonia and Greece in the 3rd and 2nd centuries BC altered what was once a luxury and privilege for the ruling elite into the predominant factor driving both social and economic policies for the Republic as a whole. The mass influx of slaves during this time period first was a sign of great wealth and power, but later destabilized an already fragile Roman class system. Farms originally run by small business families throughout Italy were soon gobbled up and replaced by enormous slave run plantations owned by the aristocratic elite.

This paper critically examines the long-standing view that Roman rural organization differed fundamentally from that of the other polities of central-southern Italy, and that this difference somehow explains Roman imperial success. First, the intellectual history of this paradigm is examined, focusing especially on 19 th century socio-evolutionary theory and on the role of landscape archaeology in the period following WWII. Then, recent archaeological studies on settlement dynamics and land division practices in ancient Italy are discussed. In light of these results, this paper proposes an alternative understanding of Roman-Italic rural development and land division practices and as such also questions the ancient topos which associates Roman imperial success with a specific form of peasant culture. In this view, the Romans were superior to the other polities of Italy because they had discovered a powerful societal formula that managed to incorporate the sober and disciplined moral of peasant societies within the new participatory political system of the republican city-state. While neighboring communities such as the Etruscans also established forms of city-state government, they lacked the culture based on egalitarian rural values, which was necessary to create strong soldier-citizens.

This chapter examines the role that law and legal institutions played in affecting the possibilities for growth in the agrarian economy of the early Roman Empire. Roman policies sought to balance two competing goals, to promote the ownership of private land and with this the capacity of people to enter freely into mutually beneficial contractual relationships. At the same time, the Roman administration protected its revenues from private and state-owned land by enacting policies to protect the security of tenure of small farmers. The Roman administration, then, adopted policies that supported a wealthy landowning class across the Roman Empire, but it also pursued policies that tended to mitigate the effects of an increasing stratification of wealth.
